These Terms of Service are an electronic record under the Information Technology Act, 2000 and do not require any signature. By accessing or using Capnix, you agree to these terms. If you do not agree, please do not use the service.
"Capnix", "we" and "us" mean Webority Technologies Private Limited, and the Capnix website, portals and services it operates. "You" means the person using Capnix and the business they represent. "Lender" means a bank, NBFC or other regulated lender on our panel that may consider your loan requirement. "Lender Partner" means a firm through which we route requirements to lenders, and its authorised staff. "Partner" means a Chartered Accountant, DSA, consultant or other referral partner registered on our partner programme. "Loan requirement" means the funding you ask for through Capnix. "Lender application" means a single submission of that requirement to one lender.
Capnix is a product owned and operated by Webority Technologies Private Limited (CIN: U72900HR2019PTC079747), incorporated in India with its registered office at 629-634, Vipul Trade Centre, Sector-48, Sohna Road, Gurugram, Haryana 122018, India. Capnix runs your loan journey end to end: we analyse your business, prepare your file, match you to suitable lenders from our panel, build and submit your application, and manage it through to disbursal. What Capnix is not: Capnix is not a lender. We do not lend money, and we do not set or control loan products, interest rates, eligibility or approvals, all of which are decided solely by our partner lenders.
Where a lender on our panel is a bank or NBFC regulated by the Reserve Bank of India, Capnix acts as a Lending Service Provider engaged by that lender, and we are paid by the lender and not by you. We do not lend, hold or disburse loan funds, and we do not collect repayments. Complaints about a loan you have taken should be raised with the lender in the first instance. Complaints about Capnix may be raised with our Grievance Officer under Section 21 below. If a complaint relating to a digital loan is not resolved within 30 days, you may escalate it to the Reserve Bank of India under the Reserve Bank - Integrated Ombudsman Scheme, 2021 at cms.rbi.org.in.
You must be at least 18 years old. If you use Capnix on behalf of a business, you confirm you are authorised to bind it, and that the information you provide is true, accurate and your own to share. Borrowers must represent a business registered in India. Partners must be authorised to refer the clients they introduce. Users at a lender or Lender Partner firm may access Capnix only through an account issued to them by their firm, may use the information they see only to assess and process the specific loan requirement it relates to, must keep it confidential, and must not copy, retain or share it for any other purpose.
Where an account is used, you sign in with a single-use link sent to your registered email address. That link is personal to you: do not forward it. Keep access to your email account secure, and report any unauthorised use of your Capnix account to dpo@webority.com.
By creating an account you agree to receive service messages from us by email, SMS and WhatsApp, including sign-in links, status updates on your loan requirement, and notices required by these terms. These are part of the service and cannot be switched off while your account is open. We send marketing messages only where you have opted in, and you can opt out of those at any time, without affecting your service messages or how your file is handled.
Getting a loan through Capnix costs you nothing. We do not charge you a joining fee, a file charge, or any share of your loan for preparing, submitting or managing your application. We are compensated by our partner lenders when a loan is disbursed. Separately, we offer an optional paid subscription for improvement plans. It is never required in order to apply for or receive a loan through Capnix.
For that subscription: the price, the billing period and whether it renews automatically are shown to you before you pay, and the price includes applicable GST. You may cancel at any time from your account or by writing to contact@webority.com; cancellation takes effect at the end of the period you have already paid for, and we do not refund a part-used period. We give you 30 days' notice by email before any change to the subscription price, and you may cancel before it takes effect.
We use AI-assisted tools and our team to understand your borrowing strength, present your business well, and approach the lenders most likely to fund you. The final decision, the amount, the interest rate, the terms and the timeline are entirely the lender's. We do not guarantee any loan, approval, amount, rate or disbursal. Any loan agreement is concluded directly between you and the lender, and Capnix is not a party to it.
By submitting your details and documents, you authorise Capnix to share them with the lenders we approach on your behalf, in line with our Privacy Policy. Nothing is shared with a lender without your consent, and you are free to decline any offer a lender makes.
Chartered Accountants, DSAs, consultants and referral partners may refer businesses to Capnix and earn a commission when a referred loan is disbursed. Partners must have the authority to refer a client and must obtain that client's consent before sharing their details. The Partner Terms set out the commission basis, the payout timing and the conditions of payment in full; they are published in the partner portal, are shown to you before you register, and form part of these terms for partners. Where the Partner Terms and these terms conflict on a partner matter, the Partner Terms prevail. We give 30 days' notice before any material change to them.
No unlawful use, no misrepresentation, no infringement of others' rights, no malware or unauthorised access, and no attempt to reverse-engineer, scrape or disrupt the service.
The platform, software, analysis tools, brand and content are owned by Webority Technologies Private Limited and protected by law. We grant you a limited, non-exclusive, non-transferable right to use them for your own business. Third-party and open-source components remain subject to their own licences.
Your data remains yours: you keep ownership of everything you upload. So that we can do the work you have asked us for, you grant us a limited, non-exclusive, royalty-free licence to store, process, analyse and, with your consent, share that material for the purpose of running your loan journey and improving our service. That licence ends when the material is deleted under our Privacy Policy, except where we must retain a copy by law. We may use anonymised, aggregated data that cannot identify you or your business.
Capnix prepares, submits and manages loan applications with third-party lenders; it does not lend, and it does not provide financial, investment, legal or tax advice, and our analysis does not constitute a credit-bureau score. The service is provided "as is" and, except as required by law, we disclaim all other warranties, express or implied.
Any figure, score, estimate or answer produced by our calculators, readiness checks, AI assistant or published content is indicative only, is based on the information available to us at that moment, and is not an offer, an approval, or a promise of any rate, amount or timeline. Only a lender can tell you what you will actually be offered.
To the extent permitted by law, neither party is liable for indirect, incidental or consequential loss, and we are not liable for the acts, decisions, terms or conduct of any lender. Our aggregate liability is capped at the greater of ₹10,000 or the total fees you paid us in the twelve months before the claim arose. This cap does not apply to fraud, wilful misconduct, or liability that cannot be limited under law.
You agree to indemnify Webority Technologies Private Limited against third-party claims arising from your breach of these terms, your misuse of the service, or your infringement of any law or third-party right.
You may stop using Capnix or close your account at any time. We may suspend or terminate access for anyone who breaches these terms, and except where the breach is serious or we are required to act immediately, we give you notice and a chance to put it right first. If you hold a paid subscription when we terminate without cause, we refund the unused part of the period you have paid for. Your data is dealt with under Section 13 of our Privacy Policy.
Sections 02 (Definitions), 13 (Intellectual property), 14 (Disclaimers), 15 (Limitation of liability), 16 (Indemnification), 19 (Governing law and disputes), 21 (Grievance Officer) and 22 (General) survive termination.
We are not liable for any delay in or failure of our service caused by something outside our reasonable control, including an act of God, natural disaster, epidemic, war, civil unrest, strike, a change in law or regulatory direction, a failure or outage at a lender, credit bureau, account aggregator, government portal, payment system, telecommunications network or cloud provider, or a cyber attack. Where such an event continues for more than 30 days, either party may end this agreement on written notice without liability.
These terms are governed by the laws of India. The parties will first attempt to resolve any dispute in good faith, and either party may refer it to arbitration once 30 days have passed from written notice of the dispute. The dispute is then referred to a sole arbitrator appointed by agreement between the parties, or failing agreement within 30 days, appointed under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration is Gurugram, Haryana, and the language is English. The courts at Gurugram, Haryana have exclusive jurisdiction for matters not subject to arbitration.
We may update these terms. Before any material change we give you at least 15 days' notice, by email to your registered address and by updating the "Last updated" date at the top of this page. If you continue to use Capnix after the change takes effect, you accept the updated terms; if you do not agree, you may stop using Capnix and close your account before that date. Notices to you are sent to your registered email address and are treated as received on the next working day. Notices to us must be sent to contact@webority.com or to our registered office in Section 23.
Under Rule 3(2) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, our Grievance Officer is Mr. Navneet Singh, Webority Technologies Private Limited, 629-634, Vipul Trade Centre, Sector-48, Sohna Road, Gurugram, Haryana 122018, India. Email contact@webority.com, phone +91 95990 06518. We acknowledge every complaint within 24 hours and dispose of it within 15 days of receipt.
If any part of these terms is held to be invalid or unenforceable, that part is severed and the rest continues in force. If we do not enforce a right, we do not waive it. These terms, together with our Privacy Policy and Cookie Policy, are the entire agreement between you and us on their subject matter and replace anything said or written before, other than a statement made fraudulently. You may not assign or transfer these terms without our written consent. We may assign them to a group company or to a buyer of the Capnix business on notice to you. Nothing in these terms creates a partnership, agency or employment relationship between you and us, and no third party may enforce them.
